2.2
The Website is intended for Buyers acting as consumers and purchasing Products for personal use, outside the scope of their commercial, industrial, artisanal, professional or agricultural activities.
Le TEA reserves the right to refuse or cancel an Order where there are reasonable grounds to believe that the Order is fraudulent, does not correspond to a genuine consumer purchase, or is otherwise permitted to be refused or cancelled under applicable law.
2.3
These Terms apply to Orders delivered to the countries and territories in which Le TEA offers delivery.
ARTICLE 3 — PURPOSE AND ACCEPTANCE OF THE TERMS
3.1
These Terms & Conditions of Sale define the conditions applicable to the sale and delivery of Products by Le TEA.
They set out, in particular, the conditions relating to Orders, payment, delivery, returns, legal guarantees and the rights and obligations of the Buyer and the Seller.

3.5
The failure of either party to exercise a right under these Terms in a particular circumstance does not constitute a waiver of that right for the future.
ARTICLE 4 — PRODUCTS
4.1 Product Information
Information relating to each Product is provided on the relevant Product page before an Order is placed.
This information includes, where applicable, the Product's essential characteristics, materials, composition, colour, dimensions, options, care instructions and other relevant information.
The applicable Product price and any delivery charges are communicated to the Buyer before the Order is confirmed.
Le TEA takes reasonable care to present its Products as accurately as possible. The actual appearance of a Product may vary slightly from its appearance on screen, particularly in terms of colour, due to differences in screens, devices and display settings.
Minor variations resulting solely from display conditions do not constitute a defect.
4.2 Natural Materials
Le TEA Products may be made using natural leather and other natural materials.
Variations in grain, texture, colour and appearance may naturally occur from one Product to another. Such characteristics are inherent to natural materials and are not, in themselves, considered defects.
4.3 Product Availability
Products are offered for sale subject to availability.
Le TEA may modify the range of Products offered on the Website at any time, subject to applicable law.
If a Product becomes unavailable before an Order is confirmed, Le TEA will inform the Buyer as soon as reasonably possible.
Where Le TEA is unable to fulfil an Order because a Product is unavailable after the Order has been confirmed, the Buyer will be entitled to the remedies provided by applicable law, including a refund where required.
ARTICLE 5 — PRICES
5.1
Product prices are displayed in Euro (€).
Prices displayed to consumers include all taxes legally applicable to the sale.
Delivery charges and other mandatory additional costs are not included in the Product price unless expressly stated. They are communicated to the Buyer before the Order is confirmed.
5.2
Le TEA may modify Product prices at any time.
The price applicable to an Order is the price agreed with the Buyer and confirmed by Le TEA at the time the Order is accepted.
Price changes do not affect Orders already confirmed.
5.3
In the event of an obvious pricing error, including an error resulting from a technical or manual error, Le TEA will inform the Buyer as soon as reasonably possible.
Where permitted by applicable law, Le TEA may cancel an Order affected by such an obvious error. If payment has already been made, the amount paid for the affected Order will be refunded.
5.4
The Order confirmation will state the total amount payable or paid by the Buyer, including the applicable Product price and delivery charges.
ARTICLE 6 — ORDERING PROCESS
6.1 General
Products are presented on the Website. Orders are currently arranged directly with Le TEA rather than completed through an online checkout or payment form.
An account is not required to place an Order.
Le TEA does not provide a permanent personal shopping account or customer account for placing Orders.
6.2 Product Selection and Order Information
The Buyer selects the Product and any options made available on the relevant Product page.
To request an Order, the Buyer may contact Le TEA by email at order@letea.fr or through the official Le TEA Instagram account linked on the Website.
Before an Order is confirmed, the Buyer is provided with the information necessary to review the Order, including:
- the Product selected;
- the quantity, where applicable;
- the applicable price;
- any selected options;
- delivery information and charges;
- the total amount payable;
- the information necessary for delivery and contact.
The Buyer is responsible for ensuring that the information provided is accurate, including their name, email address, telephone number and delivery address.
6.3 Confirmation and Payment
Before an Order is confirmed, the Buyer must accept these Terms & Conditions of Sale and provide the information required to process the Order.
Prices are displayed in Euro (€). The payment method and payment arrangements are communicated and agreed directly with the Buyer before the Order is accepted.
Orders are currently arranged directly with Le TEA by email or through the official Le TEA Instagram account rather than through an online payment form.
Le TEA does not request full payment card details through the Website, by email or through Instagram messages.
The total amount payable, including any applicable delivery charges, is communicated to the Buyer before the Buyer confirms the Order.
An Order becomes confirmed when Le TEA has accepted the Order and the agreed payment conditions have been fulfilled.
6.4 Order Confirmation
Once the Order has been confirmed, Le TEA sends the Buyer an Order confirmation by email or through another agreed written communication channel.
The confirmation will include, where applicable:
- the Order number;
- the Product or Products ordered;
- quantities;
- selected options;
- prices;
- delivery charges;
- the total amount payable or paid;
- delivery information;
- any information required concerning the right of withdrawal or returns.
The Buyer is responsible for providing valid contact information and for checking the Order confirmation.
The Buyer is advised to retain the Order confirmation for their records.
6.5 Refusal or Cancellation of an Order
Le TEA may refuse or cancel an Order for a legitimate reason permitted by applicable law, including:
- Product unavailability;
- failure to complete the agreed payment arrangements;
- an obvious pricing or technical error;
- fraudulent activity or an attempted fraudulent transaction;
- an Order that does not correspond to a genuine consumer purchase.
Where an Order is cancelled after payment has been received, Le TEA will refund the amount legally due to the Buyer in accordance with applicable law.
ARTICLE 7 — DELIVERY
7.1 Delivery Conditions
Products are delivered to the address agreed with the Buyer when the Order is confirmed.
Delivery charges and applicable delivery information are communicated before the Order is confirmed.
7.2 Delivery Time
Once the Product has been completed and dispatched, delivery is estimated at 5–20 days, depending on the destination and carrier.
For made-to-order or bespoke Products, production time is additional to the delivery period and will be communicated to the Buyer before the Order is confirmed.
Le TEA will deliver the Product within the period indicated to the Buyer. Where no specific delivery period has been agreed, the statutory delivery rules applicable to the Order apply.
If Le TEA fails to deliver within the applicable period, the Buyer may exercise the rights available under applicable law, including requiring delivery within an additional reasonable period and, where the legal conditions are met, terminating the contract.
7.3 Delivery Charges and Additional Costs
Applicable delivery charges are communicated before the Order is confirmed.
The amount may depend on the destination, delivery method and Products ordered.
For deliveries to certain destinations outside the European Union, customs duties, import taxes or other charges may apply. Where applicable, information concerning such charges will be provided in accordance with applicable law.
7.4 Transfer of Risk
The risk of loss or damage to the Product passes to the Buyer when the Buyer, or a third party designated by the Buyer other than the carrier, physically takes possession of the Product.
7.5 Delivery Issues
The Buyer is encouraged to check the package and Product upon delivery and to contact Le TEA promptly if visible damage or an anomaly is identified.
Failure to make a reservation or observation at delivery does not deprive the Buyer of their statutory rights or legal guarantees.
ARTICLE 8 — RIGHT OF WITHDRAWAL AND RETURNS
8.1 Statutory Right of Withdrawal
For Products to which the statutory right of withdrawal applies, the Buyer has fourteen (14) days from receipt of the Product to exercise the right of withdrawal without having to provide a reason.
Where an Order contains several Products delivered separately, the withdrawal period begins upon receipt of the last Product.
The Buyer may exercise the right of withdrawal by sending Le TEA an unequivocal statement of their decision by email at contact@letea.fr. The Buyer may also use the withdrawal form attached to these Terms. The use of the withdrawal form is not mandatory.
After communicating their decision to withdraw, the Buyer must return the Product without undue delay and no later than fourteen (14) days after communicating the withdrawal decision.
Le TEA will provide the applicable return instructions and return address by email. The Buyer must then return the Product to the address provided by Le TEA.
8.2 Cost of Return
The Buyer is responsible for the direct cost of returning the Product unless Le TEA has agreed otherwise or applicable law provides otherwise.
8.3 Condition of Returned Products
The Buyer may handle and inspect the Product only to the extent necessary to establish its nature, characteristics and functioning.
The Buyer may be liable for any diminished value resulting from handling beyond what is necessary for such inspection, in accordance with applicable law.
Where possible, the Buyer is encouraged to return the Product with its original packaging and accessories.
8.4 Refund
Where the right of withdrawal is validly exercised, Le TEA will reimburse the amounts required by applicable law.
The refund will include the standard delivery costs paid by the Buyer where required by law.
Additional costs resulting from the Buyer having selected a more expensive delivery method will not be reimbursed beyond the cost of the standard delivery option.
The refund will normally be made using the same payment method used for the original transaction, unless otherwise agreed with the Buyer and provided that the refund does not result in additional costs for the Buyer.
Le TEA may defer the refund until the Product has been received or until the Buyer has provided evidence that the Product has been returned, whichever occurs first.
8.5 Personalized Products
The statutory right of withdrawal does not apply to Products made to the Buyer's specifications or clearly personalized where the legal conditions for this exception are met.
Whether a specific personalized Product is excluded from the statutory right of withdrawal will be indicated to the Buyer before the Order is confirmed.
ARTICLE 9 — DAMAGE, DEFECTS OR ANOMALIES
9.1
In the event that a Product is received damaged, defective or different from the Product ordered, the Buyer should contact Le TEA using the contact details provided on the Website.
The Buyer may be asked to provide the Order number, a description of the issue and, where useful, photographs or other information to help Le TEA assess the claim.
Such requests do not restrict or replace the Buyer's statutory rights.
9.2
Where a return is required, Le TEA will inform the Buyer of the applicable procedure.
The applicable remedy will depend on the nature of the issue and the legal guarantee or other right concerned.
ARTICLE 10 — LEGAL GUARANTEES
All Products sold by Le TEA benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, in accordance with applicable French law.
The legal guarantees apply independently of the Le TEA Care & Repair Service described in Article 11.
10.1 Legal Guarantee of Conformity
In accordance with Article L.217-3 of the French Consumer Code, Le TEA is liable for defects of conformity existing at the time of delivery and appearing within two (2) years from delivery.
Examples of non-conformity may include a Product that does not correspond to the Product, colour, configuration or other contractual characteristics ordered.
For new Products, defects of conformity appearing within twenty-four (24) months from delivery are presumed to have existed at the time of delivery, subject to the exceptions provided by law.
10.2 Legal Guarantee Against Hidden Defects
In accordance with Articles 1641 et seq. of the French Civil Code, Le TEA is liable for hidden defects affecting a Product where such defects make the Product unfit for its intended use or substantially impair its use.
The Buyer may bring an action based on the legal guarantee against hidden defects within two (2) years from discovery of the defect, in accordance with applicable law.
Where this guarantee applies, the Buyer may choose, subject to applicable law, between returning the Product and receiving a refund of the purchase price, or keeping the Product and receiving a corresponding reduction of the purchase price.
10.3 Exercise of Legal Guarantees
The Buyer may contact Le TEA through the contact details provided on the Website to report a suspected lack of conformity or hidden defect.
Le TEA may request information reasonably necessary to assess the claim, such as the Order number, a description of the issue, photographs or other evidence.
Where the legal guarantee of conformity applies, the Buyer may request the repair or replacement of the Product, subject to the conditions and limitations provided by applicable law.
Where repair or replacement is legally unavailable, not carried out within the applicable legal period, or otherwise falls within a circumstance allowing further remedies, the Buyer may be entitled to a price reduction or termination of the contract in accordance with applicable law.
10.4 Statutory Guarantee Information Box
The following statutory information applies to the legal guarantees available to the consumer under French law.
The consumer has a period of two years from delivery of the Product to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only needs to establish the existence of the lack of conformity and not the date on which it appeared.
The legal guarantee of conformity gives the consumer the right to repair or replacement of the Product within thirty (30) days following the request, without charge and without major inconvenience, subject to the conditions provided by law.
If the Product is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.
If the consumer requests repair and the Seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.
The consumer may obtain a reduction in the purchase price by keeping the Product or terminate the contract and receive a full refund against return of the Product where the conditions provided by law are met.
The legal guarantee of conformity applies independently of the Le TEA Care & Repair Service.
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the Product is kept or a full refund against return of the Product.
10.5 Exclusions That Do Not Affect Statutory Rights
Subject always to the Buyer's statutory rights, Le TEA is not responsible for damage resulting exclusively from:
- normal wear and tear;
- the natural evolution of the leather, including patina;
- accidental damage;
- use contrary to the intended purpose of the Product;
- failure to follow applicable care instructions;
- unauthorised modifications or repairs, where such intervention caused or contributed to the damage.
These exclusions do not apply where the issue constitutes a lack of conformity or a hidden defect for which Le TEA remains legally liable.
ARTICLE 11 — LE TEA CARE & REPAIR — AFTER-SALES SERVICE
11.1 Nature of the Service
In addition to the statutory legal guarantees described in Article 10, Le TEA provides a long-term after-sales service intended to preserve, maintain and repair its leather goods over time.
This service is offered without a fixed time limit and is intended to support the continued use and preservation of Le TEA Products. It does not replace, restrict or limit the Buyer's statutory rights.
11.2 Scope and Availability
The Buyer may contact Le TEA at any time to request an assessment of a Product for care, maintenance, repair or restoration.
The service may be requested worldwide, subject to applicable shipping, customs requirements, technical feasibility and the availability of appropriate materials or components.
11.3 Repairs and Restoration
Where a repair or restoration is technically feasible, Le TEA may propose an appropriate intervention together with an estimated timeframe.
For interventions falling outside the statutory legal guarantees, including repairs arising from normal wear, accidental damage, improper care, misuse or other causes unrelated to a manufacturing defect, Le TEA may provide a quotation before carrying out the work.
11.4 Authenticity and Prior Intervention
Before accepting a repair, restoration or other after-sales request, Le TEA may verify that the Product corresponds to a genuine Product sold by Le TEA and may take into account any prior unauthorised modification or repair.
Where a Product has been modified or repaired by an unauthorised third party, Le TEA may refuse or limit a proposed after-sales intervention where the prior intervention makes the requested work technically impossible, unsafe or inappropriate, subject always to the Buyer's statutory rights.
11.5 How to Request the Service
The Buyer may request the Le TEA Care & Repair Service by contacting Le TEA through the Customer Service contact details.
The Buyer may be asked to provide proof of purchase, the Order number, photographs and a description of the issue.
Le TEA may inspect the Product before determining whether and how the requested service can be provided.
Where a request is accepted, Le TEA will determine the appropriate intervention, which may include care, maintenance, repair, restoration or another appropriate service.
The Care & Repair Service does not automatically entitle the Buyer to replacement or refund where the appropriate intervention is care, maintenance or repair.
11.6 Statutory Rights
The Care & Repair Service applies without prejudice to the Buyer's rights under the legal guarantee of conformity and the legal guarantee against hidden defects.
ARTICLE 12 — PRODUCT AUTHENTICITY
For any return, exchange, repair or other return of a Product, Le TEA may verify that the Product corresponds to the Product originally sold by Le TEA and, where reasonably necessary, verify its authenticity.
If a returned Product is determined to be counterfeit or does not correspond to a Product sold by Le TEA, Le TEA may refuse the requested return, exchange, refund or repair, subject to applicable law.
Where a returned Product is suspected of being counterfeit, Le TEA may take any action permitted or required by applicable law, including retaining the Product or reporting the matter to the competent authorities.
Le TEA sells authentic Products through its official sales channels.
ARTICLE 13 — LIMITATION OF LIABILITY
13.1 Products
Le TEA takes reasonable care to ensure that the Products offered on the Website comply with applicable legal and regulatory requirements.
Subject to the Buyer's statutory rights and legal guarantees, Le TEA shall not be liable for damage resulting exclusively from:
- accidental loss or damage occurring after the Product has been delivered, except where applicable law provides otherwise;
- use of the Product contrary to its intended purpose or care instructions;
- improper maintenance or failure to follow applicable care instructions;
- improper storage of the Product;
- modifications or repairs carried out by the Buyer or by an unauthorised third party, where such intervention caused or contributed to the damage.
These limitations do not affect liability which cannot legally be excluded or limited.
13.2 Website Access
Le TEA may temporarily suspend or restrict access to all or part of the Website where necessary, including for maintenance, updates, security measures or technical interventions.
Le TEA will take reasonable measures to maintain the availability and proper functioning of the Website. However, the Website may occasionally be unavailable or affected by technical errors, bugs, interruptions or events beyond Le TEA's reasonable control.
To the extent permitted by law, Le TEA shall not be liable for losses resulting solely from a temporary interruption, unavailability or technical malfunction that is not attributable to a failure by Le TEA to fulfil its legal obligations.
Nothing in these Terms limits or excludes any liability that cannot legally be excluded or limited.
ARTICLE 14 — FORCE MAJEURE
14.1
Le TEA shall not be liable for delay or failure to perform an obligation under an Order or these Terms where such delay or failure results from an event of force majeure as defined by applicable law.
Where such an event occurs, Le TEA will inform the Buyer as soon as reasonably possible where the circumstances permit.
The affected obligations may be suspended for the duration of the force majeure event, subject to the Buyer's rights under applicable law.
14.2
For the purposes of these Terms, force majeure is understood in accordance with Article 1218 of the French Civil Code.
Where the impediment is temporary, performance may be suspended for the duration of the event. Where the impediment is permanent, the consequences provided by applicable law shall apply.
ARTICLE 15 — RETENTION OF TITLE
The Products remain the property of Le TEA until Le TEA has received full payment of the purchase price and all other amounts due in connection with the Order.
Once full payment has been received, ownership of the Product transfers to the Buyer, subject to the Buyer's statutory rights.
ARTICLE 16 — INTELLECTUAL PROPERTY
16.1
The Le TEA name, trademarks, logos, designs, photographs, illustrations, product designs, texts, graphics, videos, sounds, visual identity, packaging and other elements appearing on the Website, Products or other Le TEA materials are protected by applicable intellectual property laws and, where applicable, are owned by Le TEA or used by Le TEA under the rights and authorisations required for their use.
16.2

- photographs and product images;
- product designs and visual concepts;

16.3
The Website and its content may be accessed and used for personal and non-commercial purposes, subject to these Terms and applicable law.
Nothing in these Terms transfers any intellectual property rights to the Buyer or User.
Unauthorised use, reproduction or exploitation of protected content may constitute an infringement of intellectual property rights and may give rise to the remedies available under applicable law.
ARTICLE 17 — PERSONAL DATA
17.1

The mediation procedure remains voluntary and does not prevent the Buyer from bringing proceedings before a court.
18.4 Courts

Nothing in these Terms prevents the Buyer from exercising any mandatory rights or remedies available under applicable consumer protection law.
